Mediation
Mediation is a process in which a third-party neutral assists in resolving a dispute between two or more parties. It is a non-adversarial approach to conflict resolution. The role of the mediator is to facilitate communication between the parties, assist them in focusing on the real issues of the dispute, and generate options that meet the interests or needs of the parties in an effort to resolve the conflict.
Initially the parties meet collectively with the mediator to discuss the facts of the case. Then the parties typically adjourn to separate rooms. The mediator assists in settlement communications and negotiations, but the parties retain the decision-making power.
In the absence of settlement, the parties retain the right to take their case before the court. However, even partial agreements can help the parties narrow the issues involved and limit the time and expense of going to court.
Benefits of Mediation
Mediation can be a beneficial alternative to trial in many different type of cases and is especially so in cases where there are highly emotional issues involved or where there is a continuing business or personal relationship. The benefits of mediation are that it promotes communication and cooperation, reduces conflict, is private and confidential, and is cost effective. Most cases are resolved successfully through mediation and the parties are typically happier with the outcome of the case if they are able to successfully mediate it.
Cost of Mediation
Michelle charges $200 an hour for mediation services. The fee is typically split between the parties (unless agreed upon otherwise) and is due at the completion of the mediation session.
